The use of this website, 'indiansummercompany.co.uk', and all transactions are subject to the following terms and conditions.

Legal Contract
Once you have placed your order with 'Indian Summer Company', we will send you an email confirming your order, detailing the items you have ordered, method of payment and address for delivery and the total cost including post and packing charges. If there are any errors you should let us know straight away by email or by phoning 01308 867135.

Once the payment for your order has been confirmed, the goods will be packed and despatched.

A contract will exist between you and 'Indian Summer Company' for the sale of goods by us to you only when your payment card has been charged, we have raised an invoice and the goods have been despatched. This shall be deemed to be our acceptance of your offer and to have been effectively communicated to you.

Our contract is to be interpreted and enforced within the laws of England, in its entirety and will be subject to the jurisdiction of the English courts.

This does not affect your statutory rights as a consumer.

Cancellation
You can cancel your order at any time up to the point of despatch. After that the normal returns policy applies.

Prices and Taxes
All prices are in Sterling (GB pounds). We can show prices in Euros and other currencies too but these are a guide only. Transactions from overseas customers will be charged in Sterling and exchange rates calculated by their own card issuer. You are responsible for any additional import duties.

We are registered for VAT. Our VAT number is 902 2328 66. Prices for FirstBIKEs, (and bike accessories), Wheelybugs, Triker products, Bikeboards, all Family Fun products and Moonbags include VAT at 17.5%. ( now 15%, with effect from 5.30pm. on 30th November 2008)

We reserve the right to change prices but will not increase the price of an item once it has been ordered unless there has been a genuine price error. We will contact you in this instance to discuss.

Payment and Security
We accept Mastercard, UK and International Maestro, Visa, Delta, Electron, JCB and Switch Solo.

Payment can be made online using our secure payment processing provider – Protx. We know that security and the prevention of fraud are very important to our customers and we take this very seriously. You can be assured of the highest security measures. Look for the padlock at the bottom right of the screen and that there is 'https' at the beginning of the browser address (top left). All payment details are encrypted and we do not see or retain information on any of your card details. We apply stringent fraud prevention measures to all transactions including using Verified by Visa and Mastercard Secure. This provides you the customer with an extra security measure which not all websites use.

Cheques are also accepted but we will need 5 working days for cheque clearance before despatching your order.

Privacy
Like security, we take the privacy of our customers very seriously. We do not sell, share or pass on any details you provide us.

In order to fulfil an order we need to collect personal information such as name, address, telephone number and email address. We store this information securely, following Data Protection guidance. We may use the information to contact you about your order or to let you know about current offers.

Our banking provider – Protx and Barclaycard Merchant Services, handle your payment card details. We do not see any of your payment details. They undertake the authorisation and verification of your payment. They have their own strict security and privacy policies.

Registration
When registering as a customer, you warrant that:

The personal information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and

You will notify us immediately of any changes to the personal information by amending your customer information in the 'my account' section.

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Indemnity
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your personal information.
